Terms of Service

1. Service Object and Informational Nature

Psica offers conversational support inspired by CBT. It does not provide diagnosis, treatment or telemedicine and is not a medical device. If in the future functions or purposes fall within the scope of Regulation (EU) 2017/745, the Provider will comply with applicable obligations in advance.

2. Non-Emergency – Crisis Management

Psica is not an emergency service. In case of immediate danger or suicidal thoughts, contact 112/118 or go to the Emergency Room. In Italy, the Samaritans number 800 86 00 22 is available. The service adopts prudent and safety-oriented messages.

3. Age Requirements

The service is intended for individuals over 16 years old. Parental/guardian consent is required for minors. In Italy, autonomous digital consent is valid from 14 years old; below that age, parental consent is required.

4. Registration, Account Security

The user guarantees truthful data and custody of credentials. The Provider may suspend/close accounts for violations, risks or requests from authorities, consistent with DSA due diligence duties.

5. Permitted Use and Prohibitions

Prohibited: illegal content, hate speech, harassment, deliberate disinformation, use for training models without consent, unauthorized scraping and sending third-party data without legal basis. The Provider may remove content and restrict access according to the DSA and EU rules on unfair practices.

6. AI-Generated Content

AI responses are probabilistic, may contain errors and do not replace a professional. The Provider excludes implied warranties to the extent permitted by law and suggests setting a maximum liability cap and exclusion of indirect damages.

6.1 Chatbot Limitations and Liability

Psica's chatbot provides conversational support and suggestions based on CBT logic, but cannot replace a qualified professional. The Provider is not responsible for any damages, accidents, dangerous or self-harming behavior resulting from the use of the chatbot, nor for decisions made by the user based on its suggestions. The user must not consider the service as a substitute for medical care, emergencies or professional interventions. In case of crisis, suicidal thoughts or risky behavior, the user must immediately contact emergency services or qualified professionals.

7. Intellectual Property and Licenses

The software, trademarks and interface are protected. The user retains rights to their own content and grants a license for use necessary for the provision and improvement of the Service.

8. Personal Data and Privacy

Processing is described in the Privacy Policy. Health and wellness data fall within special categories (Art. 9 GDPR) and require an adequate legal basis and enhanced measures, including, where applicable, an impact assessment (DPIA). Users can exercise GDPR rights and contact the Supervisory Authority.

9. Retention, Security and Availability

Data is retained for the time necessary for the stated purposes and then deleted or anonymized. The Provider applies appropriate technical and organizational measures and manages any violations according to the GDPR. Service availability may be suspended for maintenance or force majeure.

10. Fees and Consumer Rights

Any prices, conditions and right of withdrawal will be communicated before contract conclusion, in compliance with the Consumer Code; for digital content/services, rules on conformity and remedies apply.

11. Limitation of Liability

To the extent permitted by law, the Provider is not liable for indirect, consequential damages or loss of data/profit. Overall liability is limited to the amount actually paid in the preceding 12 months (if the service is free, to €100), without prejudice to the consumer's mandatory rights and cases of willful misconduct or gross negligence.

12. Suspension and Termination

The Provider may suspend or terminate the account for violations, security risks or requests from authorities, providing, when possible, advance notice and information on remedies, consistent with the DSA. Users may close the account at any time.

13. ADR/ODR and Complaints

The European ODR platform has been discontinued: it is no longer possible to submit new complaints and sites must remove the link. For assistance with ADR mechanisms and for cross-border complaints, you can contact the European Consumer Centre Italy (ECC-Net) or national ADR bodies.

14. Subscriptions and Payments

Subscriptions to the service are managed through the secure payment platform Stripe. No payment card data is stored or processed directly by Psica. Given the nature of the service, which involves immediate and recurring costs in credits on external services to ensure chat functionality, activated subscriptions are non-refundable. Users may however stop automatic renewal at any time from their account settings.

15. Applicable Law and Jurisdiction

Italian law. For consumer users, jurisdiction of the user's place of residence or domicile; for other users, exclusive jurisdiction of Salerno.

16. Changes to Terms

The Provider may update the Terms with advance notice. Changes apply from the indicated date; continued use implies acceptance. Consumer users may withdraw if they do not accept the changes.
